Well I believe the issue is just as all have stated above, access is inherent and walking/jogging or running on beach shoreline with dog etc is not trespassing. Anything else longer of a stay is trespassing. Another factor to consider is with multiple owners as you walk along the beach what if one is ok with walking and the other is not the law needs to be clear. all the high-water mark and LWM stuff is a factor but I think the better answer the amount of time or behavior the person or animal is spent or doing on the beach front.is the biggest factor of trespassing on the beach, similar to no loitering laws. People do need to be respectful and picking up after your animal is one of those things that needs to be done. but walking at the water edge is aright of life librty and happiness. I agree with one writer if you don’t like it move, you really didn’t t think people would be walking on the waters edge of the beach a totally unreasonable expectation of a reasonable person.
That being said many animals inhabit the beach filthy seagulls are one of them I would rather have a well behaved dog then the seagull walking past my beach.
